Our work agreement resources are designed to be considered and customised by you before they are used in the circumstances specific to your workplace. You must read through this Product Disclosure Statement carefully to help you understand what MatarazzIR™ does feature, what MatarazzIR™ does not feature, and what your responsibilities are.

About the product - MatarazzIR

1. MatarazzIR™ is a catalogue of work agreement resources. The resources are illustrative and informational calculations and clauses.

2. MatarazzIR™ is designed for skilled contractors - hirers and workers - to help the take up of work when there is demand. 

3. Being able to satisfy work demand, when and where it occurs, is being prepared – as a skilled hirer or worker – and that starts with a valuation of the work.

4. The product helps skilled hirers and workers describe, negotiate and agree the scope, conditions and terms of a work agreement. The product illustrates the types of calculations and clauses that can inform and form a work agreement, ready to be considered and customised by you.

Choosing MatarazzIR

5. When you intend to make a work agreement, you should carefully consider the scope, conditions and terms that suit your needs including the level of obligation and level of payment that you are willing and lawfully able to agree. Sometimes obligation is also known as liability. 

6. We recommend that you obtain legal advice before finalising a work agreement. This may be important if you do not know how to identify and assess the liabilities and risks that might apply to you under the terms of a work agreement.

Australian work agreements can include: (i) employment agreements; (ii) independent contractor agreements; and (iii) enterprise (collective) agreements. 

A. MatarazzIR™ has regard to respectively: (i) National Employment Standards in the Fair Work Act 2009 (Commonwealth of Australia) (the FW Act) and industrial awards and prescribed job classifications; (ii) fair as may be distinguished from the unfairness grounds in the Independent Contractors Act 2006 (Commonwealth of Australia); and (iii) procedure for making collective agreements under the FW Act. 

B. MatarazzIR™ illustrative calculations are formatted in Google Sheets with formulae downloadable in Microsoft Excel (.xlsx). 

C. MatarazzIR™ informational clauses are formatted in Google Docs downloadable in Microsoft Word (.docx). Clauses are documented in core sets. Optional sets are preceded by a contents page. Line spacing and font have been fashioned to maximise clarity on the page and allow easy reference when turning pages. 

D. If we prepare a document in table form, we make customisation easy: grid lines may be suppressed for printing purposes but are apparent in Word and Excel, so you can adjust margins and select rows.

E. MatarazzIR™ work agreement resources have not taken into account your specific circumstances, excepting supply corresponding to your prepaid customised instructions (if any). 

F. Our supply of work agreement resources is not legal advice, and we are not lawyers. We often work in concert with accountancy and legal advisers. Such advisers may be engaged by you directly.

G. Our pricing for resources that include your customised instructions is subject to the number of industrial instruments (awards and work agreements) that are involved, the number of job classification pay points that are involved, and the number of pay years or periods that are involved. For clarity, 'involved' includes instruments, classifications and pay years that provide necessary relativity in order to accurately match prescribed terms to your instructions. 

Important purchasing information

8. When you purchase from the MatarazzIR™ resources code items, you purchase a thing that has not taken into account your objectives, industrial relations or legal situation, or needs. The resource is ready to be considered and customised by you, which may include your prepaid customised instructions (if any) to us.  

9. MatarazzIR™ is supplied as a digital file to enable download and customisation by you. We do not supply the product in hard copy. 

10. A MatarazzIR™ file will be available to download once payment is confirmed. 

11. A MatarazzIR™ file will be available to download by way of one email address per purchase. 

12. You must: (i) at purchase time be able to receive and safely retain the MatarazzIR™ file as available to download by way of the email address you provide; (ii) arrange your own access to software programs that are fully compatible to the Google or Microsoft MatarazzIR™ format available to download, in order to properly use the file format; and (iii) before the use of the MatarazzIR™ resource in the circumstances specific to your workplace, customise the resource to suit your objectives and needs and print it with no loss of formatting to ensure you can double-check it before use. 

13. Before we upload MatarazzIR™ to a point of sale or point of dispatch, we scan its files for common computer viruses by way of our antivirus software. We only upload files if no threats are detected by way of the scan of the files. However, we cannot guarantee that MatarazzIR™ is virus free or without defects and we recommend that you perform your own virus checking processes.

14. Our summary of MatarazzIR™ features at clause 7 of this Product Disclosure Statement refers to hirer and worker obligations that can apply in Australia. These obligations may not apply to work engagements that are governed by another country. 

15. Notwithstanding a MatarazzIR™ resource may use the term “Independent Contractor,” that does not necessarily mean that it is a correct term at law in the relevant jurisdiction. For example, an “Independent Contractor” as described in a MatarazzIR™ resource may, in some jurisdictions, be an employee at law and not an independent contractor. We recommend that the legal advice, which you are recommended to obtain before finalising a work agreement, advises you about this issue.

What to do if you have a complaint

16. The Australian Consumer Law applies to you and us if you purchase a MatarazzIR™ resource for the use for which it is lawfully intended. If you are not satisfied that supply is as lawfully intended, you can complain to your Australian Consumer Law (ACL) regulator.
